My son is a 3rd generation legal heir of property owned by his great grandfather. After it was partitioned between all the brothers of my father in law, the share that came to our family is still jointly held by my FIL, BIL and husband. My BIL has all control on it and is not willing to give my husband his share. Also I am having problems with my husband bse he doesnt earn steady income so he is also not suppporting me.
I think my FIL & BIL have made my husband sign a release deed. I am thinking of filing partition suit. What happens to my son' share if the release deed is already signed by my husband. Can it be challenged?
Please help.
