Voice recorded on mobile

 

I am a manager in a bank, sometimes I have to call personally from my mobile to defaulters for pending amount, now one customer is saying that he recorded my voice and now he will sue me.

is it possible that without my permission he can record my voice and make it as an evidence in court .

pls guide, sometimes I have to use harsh words, and demanding tone.

what should I do.

A case of extortion and defemation can be filled against you,asking for defaults in payments is another thing but if customer is able to prove that it was your private number and u have used words against the guidelines of RBI,you have surely landed yourself in trouble.

Depends on the pith and substance of the words employed by you in the recorded conversation. What you might be construing as merely harsh or demanding may not only amount to an offence under the relevant provisions of IPC, but  could also be in defiance of the guidelines laid down by the SC for the banks as to the manner in which the defaulters are to be proceeded against. You could be in real trouble.

You being the manager, it is expected of you to be be conversant with the guidelines. A copy of the guidelines has to be in your office.
