What happens

Dear experts, There was an assault case . FIR was filed and case was registered. Police came to the neighborhood and took statements of a few persons. Police filed charge sheet and hearing started in the court(GR) case. Now a Summon has come these persons asking them to go to the court as witness. Could you please inform what will happen if they do not go to the court. Will warrant will be issued against them? Regards

If the summons were properly served and the witnesses reside in a place well connected to the court, have a material information or documents vital to the case, and witnesses have no lawful reason not to attend the court, the court apart from compelling their attendance may also issue bailable or non bailable warrant, can impose penalty and attach your property. All this depends on the seriousness of the matter. Courts are directed by law to quickly discharge witnesses and may also cause the party to pay for their expenses. With so much leniency courts are bound to be strict.
