asking a very generic question
what is the best way to delay matters at court?
can we try any of the following
1. Falling sick pretty often
2. Showing office work
3. Taking care of parents
4. Changing jobs?
what would lawyers suggest if we need to delay things(lets say for few weeks for each and every hearing/trial) at court?
Delaying things at court, would definitely help husbands who are falsely implicated by wives.

would like to know what happens in court trials/proceedings, just to get a feel of it before going for the actual trial.
Is there any document/videos through which we can learn?

Simple....dude!
Find some free time on a working day, go & sit in the court-room. Get the first hand experience what happens there, sitting there whole day too!

currently not in India, so would like to find out if there are any documents/videos through which I can get a feel of it

experience it without any fear and keep faith..
nobody would have ever wished in life to see courts n stuff unless they be lawyers or judges..
Just take things as they are , somebody always has to be the first in line ..
so here in such situations of life ..lets be the chosen ones to face it all with grace..

Don't delay the court proceedings unless there is some genuine reason, they anyways move so slow.
If you delay too often, you may not get exemption when you really need it.

once 498a filed, what are the chances of getting exparte divorce decree?
assuming everything filed is false.
Shonee Kapoor (Legal Evangelist - TRIPAKSHA) 07 December 2011
What are the chances of ex-parte decree after filing of 498a: AS IT WAS BEFORE.
You get ex-parte decree by default of other party and not on your merits.

Thanks Shonee sir. I really have to appreciate your service to LCI.
before passing ex parte...shouldnt wife prove all her allegations irrespective of husband's presence?
Shivaji Rao (worker) 08 December 2011
let me make it clear....here is the sequence of cases being filed
1. RCR filed by husband
2. 498a filed by wife (on husband and his parents/brothers/sisters/uncles/aunts)
3. Wife files for divorce on DV
Husband files RCR and does not appear for 498a and for the divorce too.
once xparty divorce is granted to wife. should wife close 498a case or it can be left open and dealt with it when husband becomes available
rajiv_lodha (zz) 08 December 2011
@ Shivaji! U are right. If court grants such x parte divorce even then 498a case will be running agaist u.
@ Zeeshan!

I understand that you want to know what are the chances of divorce after winning 498a even if wife is not ready to give divorce.? It's guaranteed. And also mostly without maintenance. |

Grant of divorce is no ground for closing 498-a.
