Whether the office bearers of the society registered under the act, 1860

Whether the office bearers of the society registered under the Societies Registration Act, 1860 whose term explained long back and failed to conduct elections to elect new office bearers and the managing committee members  of the society as per the bye-laws of the society can legally represent the society before the court in a case filed against the society?

In the absence of newly elected body or in the absence of election, the present committee is deemed to be still effective until it is barred barred from functioning by an order of the competent authority.

Hence there's no legal infirmity in their representation before court or any legal forum on behalf of the society in the capacity of office bearer.
