which court??

husband and wife got married at bangalore and had two children. wife joined college and pursued b.ed and thereafter got posted at dharwad as school teacher, earning more than the husband. she lived there with her two children. husband who consented at first, later wanted his wife and children to come back and live with him in bangalore. Wife blatantly refused. 

husband filed for divorce before family court, bangalore citing mental cruelty and desertion. Wife filed her objection against the petition saying she had no intention to cause cruelty or desertion and that she is staying away for a reasonable cause.

she files a petition for restitution of conjugal rights before the district court at dharwad.

 

Can both these petitions be clubbed to be tried in one court? if so, which court and what is the procedure to do so?

as we all heard here and there that it is a male dominating society but if one go through legal aspects than he/she find something contrary, anyways we concern with this issue, so i would not be wrong if say that the place of suing will be your wife's place .for further clarifications you can go through sec-19 of HMA and sec-16 of CPC.
