who can file case in customer forum

If money is withdrawn with fraud.. Then can we file case against bank in consumer forum...and after FRI is filed against person misusing cheque ia filed... Bank has passed cheque even if there were scratches in sign. Cheque was of 3 yrs back. And od in Current account. Can we as normal person go to customer forum? Against bank to get money back? What are requirements? What is max fees in general a lawyer should charge for such recovery to go to customer forum?
