Who fixes dates

Hi,

Would like to know:

1. Who fixes the dates for next hearing. In Bihar, I learnt, it's the Bench Clerk. But If it is so, does he/she consults the Judge before fixing a date?

2. What is the basis for the same, why the very next day or why 14 days or 1 month and so on...

3. Is there any minimum gap between the two dates?

1.Judge.

 

2.Depends on court work load.

 

3. 2 months.

Am Still confused.

Reason for Query: I have a title-suit case to contest in a district court in Bihar.

1. I checked the records, the court has fixed the next hearing after 15 days and this is happening since last 6-7 months

2. My lawyer told me that the hearing can take place with a gap of even 1 day.

3. Also that the next hearing date is fixed by the Bench clerk.

Maybe rules are different in Bihar compared to rest of India
