Dear Sir,

I want to know, we are three brother, my father expired 20yr before now my mother want to draft a will in name of my younger brother, both the brother have no objection on it, can it be possible in future that grand son/ daughter can challange the will, what should be have to do to secure the future of the will. the property is acuired by father ownself.

Dear Mr.Nitin Kumar

As your father died  without executing any will, all of you have rights over the property, your mother can execute a will of her share only, she cannot execute entire property that means your share and your brother /sister share on her will, if she execute a will it is not proper  in accordance with law.  All the children of your father including you sister have rights over the property.

Thanks Sir, One thing more if my father had written a WILL in the name of my mother then, we or our son can claim property.
