Will and further guidance.

Dear SIr,

Thanks for your quick response.  Will was made on 10th December 2015, is there any expiry time or time limit to mutate on our names, no any registration made, it is an just WILL.  Some one is saying with in three months we should get transferred, is it so sir.   Kindly advice.

Since the properties are self acquired, you don't have to worry, just go by the terms of the will get the same probated and get the property mutated in your name.

There is no time limit prescribed for probate of will.can be done anytime but if you suspect some fraud being played then its better to probate as early as possible as delaying probate will weaken your case

There is no time limitation for probate of will but it will good if it get probate as earliest .

There is a supreme court judgement which states that the period of limitation to have a will probated is 3 years starting since the date on which the title of anyone who is challenging the title of the beneficiary became hostile to that of the beneficiary . The same borrows the period mentioned in article 113 of the limitation act schedule . If there is some one on the family who might raise doubts to the genuineness of the will then hermit probated within 3 years since the first time it was challenged by that person . In cas everything is peaceful then you may take your time.
