Withdraw of divorce case in family court

Sir/Madam

 

How do I  withdraw a case in family court. The adv is saying it carries a fees of 7250. Is that true? If I and my lawyer don't go on the next hearing will the case be automatically dismissed. Or I should appear befor the judge alone (since the adv is asking huge fees) and submit an application that I want to withdraw the case. I will handwrite the application.

If you have not paid the fees of your advocte first you pay it and get it dismissed/withdraw.

Sir,

 

I have already paid the full fees for the advocate. He is saying that this fees is for the court. But  I don't think court takes this much fees for withdraw.

Who is your advocate and was he appointed by the Family Court as an expert to assist the Family Court as amicus curiae? Please note that no party is entitled to engaged a legal practitioner as a matter of right and it is only the Family Court that has power to engaged a Lawyer to assist the Family Court. Make an enquiry about this matter from the Family Court Judge or from the family Court Counsellors, Officers of the Family Court.

court never take any fee to withdraw any case. So talk to your counsel else appear yourself and request the judge to withdraw the case with reason and court will allow you to withdraw. Not to worrry, but if ur counsel force you then told him that u have to approach bar council. As ur counsel can get his fee settled between u but cannot force you for his illegal demands.
