Witness mischievously saying “I don’t Remember”-Implications

1. In a Criminal Trial during the Cross Examination, the complainant on being shown the correspondence initiated by him, (which could provide valuable clues about the innocence of the accused) says he is not able to recall the writing of the said letters.

(a) What is the implication of not providing the answer by the complainant?

(b) Can it be said that when a complainant says “I don’t remember” in reference to the date etc on a document he has made, then in a Criminal Trial, the document does not stand “proved” enough to the detriment of the other party
