Works committee

As per provision under Section 3 of Industrial Dispute Act, 1947,

member of works committee are selected by Recognized union if one is there.

If there are other unions besides recognized union,

Are they have right to select their members to works committees provided under the Act on the strength of their members.

is there any provision which give right to other unions to send their members to works committees.

Please give suggestion.

The section provides The representatives of the workmen shall be chosen in the prescribed manner from among the workmen engaged in the establishment and in consultation with their trade union, if any, registered under the Indian Trade Unions Act, 1926. 

Therefore a scheme has to be framed in such a manner that in the works committee there is representation of all sections of employees.  there is no provision in law that  only a recognised union is to be consulted. Any one union may not represent all sections of employee.  If there is a dispute then Labour commissioner can decide the representation.
