Wrong TDS

Dear sir ,

My employer has deducted and paid the TDS much more than the required amount in preveous quarter and had filed the TDS return for the relevent quarter on that amount . Now when the matter came to my knowledge I requested to refund the excess amount or adjust with the tax to be deducted from other employees . But they are of the opinion that the excess amount can not be refunded by them as the quarterly TDS return has already been filed mentioning therein my PAN no and it will have to be claimed by me by filing the Income Tax return only.

I want to know if there is any way that the amount can be adjusted by the employer from the tax to be deducted for other employees as why should I suffer for the mistake of someone else

The organisation, who deduct the tax at source, shall have to issue "Certificate of Tax deducted at source" to the payee. The payee is entitled to deduct the income-tax to that extent in his returns. The certificates are Form no:16 for salaried people, Form No.16A for other payees.
