Issue:
How can notices be served in commercial cases to avoid any delays?
Facts:
· An appeal was filed in the hon'ble Supreme Court to bring to notice the delay which is caused in serving the notices by the respective courts.
Appellant's contentions:
· It was contended that the delays in serving the notices leads to piling up of cases and consequently a large number of cases keeps on remaining pending in the courts. Consequently, the appellants seeked for condonation of delay in filing appeals and office reports.
Judgement:
The Supreme Court allowed the appeal. It was observed that the delay in process of serving notices has resulted into arrears in courts. Therefore, it was ordered that notices can be served by e-mail. This facility was provided in commercial cases and to the Advocates on record needs urgent interim relief only.
