HC stays CIC order asking SC to divulge logic of its verdict

 

A Central Information Commission order asking the Supreme Court to explain the rationale of one of its rulings was stayed on Monday by the Delhi High Court.

 

Justice S Murlidhar stayed the operation of the CIC order on a petition by the apex court registry challenging the order which had asked the apex court to explain the reasons of its findings while deciding a case.

 

The CIC order had asked the Supreme Court to respond to the queries, posed by one R S Misra under the transparency law and divulge to him the logic behind dismissing his special leave petition, challenging a high court order.

 

Terming the CIC order as "beyond law and jurisdiction under the Right to Information Act," the Supreme Court, in its appeal filed by advocate Deva Datt Kamat, said that a litigant cannot seek redressal by using the transparency law if his plea is dismissed by the apex court of the country.

 

The CIC had on 11th May asked the apex court to reveal its logic behind dismissing the petition of Misra by 5th June.

 

Earlier also, the Supreme Court had approached the Delhi High Court to challenge a CIC order asking it to disclose the assets of its judges and their family members.
