The Kerala state government recently dismissed many doctors who were absent from duty without the necessary permission, one of such doctors filed a petition in the Kerala HC for reviewing the decision by the government.

The Court observed that the termination without a formal inquiry is not proper as any member of the civil service can be removed or expelled from service only after a formal inquiry and given a chance to respond the levelled allegations in him.

But the court disagreed to uphold the restriction that are imposed on him and cannot avail any benefit of the service. The court further observed that petitioner was applying for visa to United States of America, and didn’t turn up for the medical examination by the board. Further the Court showed its concern on the fact that medical professionals are in a hunt for greener pastures in private sector or abroad and even indulge in private practice, which thereby create direct deprivation of good medical facilities to the patients of the lower strata of the society. The poor person who comes to government hospitals or medical colleges for treatment is deprived of the best treatment.

The High Court dismissed the doctor’s petition and directed the government to conduct a full-fledge inquiry.
