The Supreme Court ruled on 13th April 2020 (Monday) that inmates who are Coronavirus (COVID-19) positive will not be released on temporary bail or parole.
A Bench headed by Chief Justice S.A. Bobde said sufficient COVID-19 checks on prisoners due to be released should be performed.
Despite objections by Solicitor General Tushar Mehta that their release would see them mix with the native people again, the court amended its May 2019 order to allow these detenus to furnish a bond of ₹5,000 instead of ₹1 lakh. They need to also deliver two Indian citizens as sureties.
At a suo motu hearing, the Bench passed certain orders on steps taken to decongest jails, correction facilities, and detention centres. On 23 March, the Bench had ordered the States and the territories of the Union to set up special committees to review prisoners' cases and to shortlist those who could be given bail or parole.
