THE SUPREME COURT HAS RECENTLY VACATED ITS ORDER WHICH IT PASSED IN MARCH 2019, WHICH RESTRAINED OTHER COURTS FROM HEARING DISPUTES RELATING TO BCCI AND STATE CRIICKET ASSOCIATION
WHAT WAS THE ORDER?
- On March 14, 2019, the Supreme Court had passed an order which restricted other Courts in the country from hearing disputes relating to the BCCI and the State Cricket Associations throughout the country.
- The Court had specified that the order would continue till the ‘Amicus Curiae’ submits his report in this regard.
- The Court had appointed Senior Advocate P.S. Narasimha and had asked him to submit a report on pending disputes involving the BCCI and State Cricket Associations.
LATER DEVELOPMENT
- The Amicus Curiae had submitted his report on May 9, 2019.
- As per his report, most of the State Cricket Associations across the country had accepted the recommendations laid in the ‘Lodha Committee Report’.
- Most Associations have complied with the directions and conducted their elections in pursuance to these.
BACKGROUND
- In 2017, the Supreme Court had appointed a Committee.
- This was to be head by the former Comptroller and Auditor General (CAG) Vinod Rai.
- This was to run the affairs of the BCCI and assist them in implementing the recommendations of the Justice RM Lodha panel.
STATES WHICH HAVEN'T ACCEPTED
- It was reported that the Kerala Cricket Association still haven’t accepted the directions and still has cases pending against it.
- However, the dispute was closed by the Supreme Court, but allowed other courts to adjudicate it.
- Thus, it vacated its March, 2019 order by allowing other courts to preside ove the matter of a State Cricket Association.
- All other interlocutory applications pending were dismissed (except one by the Tamil Nadu Cricket Association, regarding release of funds).
