BCCI president Shashank V Manohar, Secretary N Srinivasan, vice president Chirayu Amin and ex-BCCI secretary Niranjan Rasiklal Shah have moved the Supreme Court against Calcutta High Court order directing their prosecution for indulging in perjury by using forged documents to implicate former BCCI president Jagmohan Dalmiya. BCCI and ICC vice president Sharad Pawar has already approached the Supreme Court against the same order. The petitioners are seeking stay of the impugned judgement of the High Court till final disposal of the appeal. They have challenged the High Court order on the grounds that no notice have been issued to them to present their side of story and therefore, the High Court order is violative of the principles of natural justice. Dalmiya was accused of embezzlement of BCCI funds during 1996 world cup when he was the president of BCCI. He was expelled from BCCI in 2006. He challenged his expulsion and then moved the High Court seeking initiation of criminal proceedings against several persons for using forged documents and misleading the court by filing a false affidavit. Mr Pawar has denied that he had filed this affidavit. The main controversy was that Dalmiya was expelled from BCCI under the rules which were not notified on the day of expulsion. Dalmiya was charged with misappropriating Rs 41 crore during 1996 Cricket World Cup played in India. He was the Chairman of the Organising Committee. BCCI senior office bearer Ratnakar Shetty, however, has not approached the Supreme Court against the High Court order dated November 12. A Supreme Court bench headed by Chief Justice K G Balakrishnan will hear all the six petitions on December 5.
