1. SC on eligibility for proposing a scheme under Section 230 Companies Act
• In the case of Arun Kumar Jagatramka v. Jindal Steel & Power Ltd, the Supreme Court has held that a person who is not eligible to submit a resolution process under Section 29A of the Insolvency and Bankruptcy Code cannot propose a scheme under Section 230 of the Companies Act.
• “The person of the ineligibility under Section 29A is sustainable revival and to ensure that a person who is the cause of the problem cannot be a part of the process of the solution,” opined the Court.
2. Writ petition against order of the State Consumer Commission is not maintainable: SC
• The Supreme Court has held that a writ petition filed under Article 226 against the order of the State Consumer Commission is not maintainable.
• The Supreme Court held this in a case in which a writ petition had been filed against the order of the Madhya Pradesh Consumer Commission.
• The name of this case is Mehra Bal Chikitsalaya Evam Navjat Sishu ICU v. Manoj Upadhyaya.
3. ‘Rarest of the rare case’- Batla House Encounter
• Convict Ariz Khan has been awarded death penalty in relation to the Batla House Encounter by a Delhi Court.
• While awarding death penalty, the Court held that this falls under the ambit of ‘rarest of rare case’.
• “After balancing mitigating circumstances against aggravating circumstances, it is concluded that it is the rarest of the rare case where convict deserves maximum sentence provided under the law,” the Court held.
4. Married couple reunited by the Allahabad HC
• A Habeas Corpus petition had been filed before the Court by a husband. He had alleged that his wife was detained by her family against her will.
• The Allahabad High Court reunited the couple after interacting with the wife and getting assurance from the husband that he will take care of her and provide her with all the rights.
