Apex Court: Dismisses Trinamool Congress Leader's Plea asking for 100% VVPAT Verification
This week, on Monday, the Apex Court dismissed a petition filed by Trinamool Congress Leader Gopal Seth seeking 100% verification of votes with Voter Verifiable Paper Audit Trail (VVPAT) in Electronic Voting Machines. Seth approached the Apex Court challenging the refusal of the Calcutta HC to entertain his plea.
Seth advocate argued before the bench that "free and fair election was a right of the people". The bench comprising of Chief Justice of India SA Bobde reiterated that it was not inclined to interfere with the election process in the middle and dismissed the petition.
Kerala State Consumer Commission: 3D Glasses For 3D Movies Should Be Supplied Free Of Cost If Necessary For Better Viewing
Earlier this week, The Kerala State Consumer Disputes Redressal Commission has ruled that 3D glasses necessary for watching 3D movies in theatres should be made available free of cost. In this case, the Commission was hearing an appeal from a 2016 order of the District Consumer Disputes Redressal Forum, Thiruvananthapuram, where, an Advocate Ravi Krishnan had gone to one Remya theatre to watch 3D film, 'Gravity', when he noticed that a Rs 30 fee was being collected as rent for 3D glasses, in addition to the Rs. 50 charged on the movie ticket. Although Krishnan requested that he be charged only Rs 50 since he already had 3D glasses with him, the theatre employees insisted on his paying an additional charge of Rs 30 as well.
The Advocate has approached the District Consumer forum on the claim of restrictive trade practice conducted by the theatre. The Commission after careful going through the contentions has ruled that 3D glasses necessary for watching 3D movies in theatres should be made available free of cost.
Man Incorrectly Buried As Per Muslim Rites: UOI Informs Delhi HC
This week, an India man upon his death was incorrectly buried as per Muslim rites in Saudi Arabia, the Union of India last week submitted before the Delhi HC that concerned authorities in Saudi Arabia informed their Indian Counterparts that the geographical coordinates of the grave of the Petitioner's husband had been located.
In this case, the demise of the deceased was certified by the hospital concerned, however, the official translator of the Indian Consulate incorrectly translated the said death certificate reflecting the man as a Muslim. Owning to this the wife of the deceased man had moved the Delhi High Court seeking directions to the MEA to exhume and transport the man's mortal remains to India for the purpose of conducting of rites in accordance with the deceased person's religion.
Bar Association Moves Supreme Court Challenging Tribunals Reforms Ordinance 2021
Recently, Madras Bar Association has filed a writ petition in the Supreme Court challenging the Tribunals Reforms (Rationalization and Conditions of Service, to the extent it amends Sections 184 and 186 of the Finance Act 2017, it gives the Central Government rule-making power in relation to the mode of appointment, terms of service, allowances of members etc., of various Tribunals.
The Apex Court, finding several faults with the 2020 Tribunal Rules, issued a slew of directions to modify them in the case, last November. The Madras Bar Association has again moved to the SC contending that many provisions of the Tribunal Reforms Ordinance 2021 are contrary to the categorical directions issued by the Supreme Court.
Italy yet To Deposit Rs 10 Crores Compensation in Enrica Lexie-Italian Marines Case
Recently, on Monday, the Union of India informed the Supreme Court that the Republic of Italy is yet to deposit before the Central Government the Rupees 10 crores compensation in the Enrica Lexie case related to the killing of two Indian fishermen by Italian Marines in 2012.
The Apex Court has said that it will consider the closing of the pending criminal cases in India against two Italian Marines for the killing of two Indian fishermen only after the compensation was received. After questioning as to where is the money, "We expected a quicker response from Italy", the Central Government Counsel said on the matter and the Bench adjourned the matter for next week.
Apex Court Forms Committee to Ascertain Quality & Quantity Of Yamuna River Water Released By Haryana To Delhi
Recently, on Monday, the Apex Court appointed a committee to conduct local inspection with regard to the quality and quantity of water released by the State of Haryana at Balla (upstream of the Yamuna river in Delhi), the level of the Wazirabad bank and whether the Delhi government is diverting the water to the Water Treatment lants at Wazirabad, Chandrawal and Okhla before the water reaches the Wazirabad bank.
This problem came to light after a writ petition by the Delhi Jal Board seeking appropriate directions to the state of Haryana over discharge of untreated pollutants, in view of the increased concentration of ammonia in the river water of Yamuna. In regards of the urgency of the matter, the Bench required the Committee to conduct the infection within three days’ time and to submit a report to the court within three days on the issues of firstly; quality and quantity of water being released by Haryana at Palla, the level of the Wazirabad bank and thirdly, whether the Delhi government is diverting the water to the water treatment plants at Wazirabad, Okhla and Chandrawal before the water reaches the Wazirabad bank.
