Overview

  • On 27 April 2021, the Bombay High Court questions the center on why the anti-viral drug Remdesivir is available to private individuals directly by the companies, when it should only be provided to the center first? It also said that if such instances arise again then it will be forced to pass injunction orders against such manufacturers.

How the matter came to the court

  • The Judges in the matter were referring to a plea which was filed at Aurangabad bench to register an FIR against the BJP member of Parliament from the Ahmednagar constituency by four agriculturists for an alleged unauthorized procurement and distribution of ten thousand anti-viral drugs, Remdesivir injections.
  • The Honorable Court was hearing two PIL's regarding the improper management of the COVID crisis in the State of Maharashtra.
  • When the last hearing was held the court gave certain directions regarding the availability of beds, oxygen cylinder, Remdesivir, etc., and ask the center and the state to submit their replies by 04 May 2021.
  • However, the court to check whether these directions are followed or not took up the matter on 27 April 2021.

What did the court say

  • The Bench consisted of Chief Justice Dipankar Datta and Justice G S Kulkarni of Bombay High Court.
  • The Court asked the center why the anti-viral drug Remdesivir was in the hands of a private individual directly from the company when it is supposed to be first received by the center from the company.
  • The Court also said that if such instances again come to the light, where the manufacturers are directly giving the private individuals the drug, then the court will be forced to pass an order of injunction against such manufacturer.
  • The bench will further hear the matter on coming Thursday that is 29 April 2021.
