If Hearing Was Virtual And The Judge Didn’t Know People Were Protesting Outside, How Is There An Influence? Calcutta HC Asks CBI In Narada Case

The five-judge bench of Acting Chief Justice Rajesh Bindal and Justices I. P. Mukherjee, Harish Tandon, Soumen Sen, and Arijit Banerjee was hearing the transfer application filed by CBI seeking to transfer the trial in the Narada scam case. The CBI also sought the declaration that the hearing in the trial court on May 17th was void on account of mob pressure. 

During the hearing, Hon’ble Justice Soumen Sen questioned the Solicitor General appearing on behalf of the CBI how he could say that the Judge was influenced when the hearing was on a virtual platform and had no knowledge about the people gathered outside. The Hon’ble asked that “In our country, there is a concept of open court. In our democracy, peaceful assembly and protests are allowed against executive action. So how does it create an influence on the common man that such a protest will influence Judiciary?”

System Becoming Dysfunctional Due To Frivolous Cases; Unable To Hear Matters Of National Importance: Supreme Court

It was held by Hon’ble Justice Chandrachud on Tuesday, that 95% of the cases brought before the vacation bench are frivolous due to which the Judges couldn’t focus on matters of national importance. 
The Hon’ble Judge made these observations during two instances when the court refused to entertain the petitions because they were frivolous. He continued to say that the system was becoming frivolous due to such matters.

There’s No Law Like Domestic Violence Act For Husband To Proceed Against Wife: Madras High Court

While hearing a case in which the woman had allegedly filed a suit of domestic violence against her husband just to harass him, the Madras High Court made some interesting observations on the Domestic Violence Act as well as on marriage.  Hon’ble Justice S. Vaidyanathan expressed his concern that unfortunately, there’s no law like Domestic Violence Act for a husband to proceed against the wife. No law deals with complaints against the wife in a domestic relationship. The Court also commented on the sanctity of marriage after the live-in relationships were validated under the Domestic Violence Act.

Can We Substitute State’s Decision That Environment Isn’t Conducive For Exams? Bombay High Court Asks Petitioner Challenging SSC Examinations Cancellation 

The Bombay High Court liberty to the Petitioner challenging the Maharashtra State’s decision to cancel SSC exams, to amend his plea, and challenge the new evaluation process. In response to the petitioner’s claim that the covid situation has improved, the Division bench led by Chief Justice Dipankar Dutta Justice G. S. Kulkarni observed that the new strain is targeting the youth, and even though we may think that the State’s decision is not wise, can we substitute the decision and say that the environment is conducive? The bench questioned. Advocate for the petitioner has agreed to make submissions on this aspect.

Extramarital Affair Not Ground To Assume Woman Would Be A Bad Mother Or Deny Child Custody: P &H High Court

The Punjab and Haryana High Court recently observed that an extramarital affair cannot be held as a ground to assume that a woman would be a bad mother or to deny her the child’s custody. It was held by Justice Anupinder Singh Grewal that in a patriarchal society it is quite common to cast such slurs on the moral character of a woman. The Hon’ble Court made these observations while granting the custody of a 4-year-old to her mother who was accused of having an extramarital affair by her husband.

Supreme Court Stays Delhi Hc Judgment Which Declared IGST Imposition On Oxygen Concentrators Imported By Individuals As Unconstitutional

The Delhi High Court’s order holding the imposition of IGST by the Centre on import of oxygen concentrators by individuals for personal use was stayed by the Supreme Court as unconstitutional. The special bench of Hon’ble Justices D. Y. Chandrachud and M. R. Shah issued notice on the plea and sought an answer from the petitioner who had filed a PIL in Delhi High Court. The procedure of the Delhi High Court has been stayed until further notice.

'346 Journalists Died Due To Covid': Plea In Supreme Court Seeks Compensation, Medical Aids For Media Persons 

An intervention application has been filed in the Supreme Court regarding the situation of Journalists and media personnel during the pandemic seeking directions to guarantee proper health care facilities and sufficient covid treatment to them and their families. The intervention application goes on the submit that the Media persons have still not being designated as frontline workers despite writing a letter to the Ministry of Health and Family Welfare.

Central Government Scraps CBSE Board Class 12th Exams For This Year

The Central Government has decided to scrap the CBSE board class 12th examination for this year given the uncertain surge in the Covid 19 cases throughout the country. It has been decided that the CBSE board will be required to take the necessary steps for finalizing the results of class 12th students as per well-defined criteria and in a time-bound manner. The decision came from a meeting chaired by Prime Minister Narendra Modi along with other ministers and stakeholders.
