Centre's Policy Of Paid Vaccination For 18-44 Years Prima Facie Arbitrary & Irrational: Supreme Court
The bench of Hon’ble Justices D. Y. Chandrachud and L. Nageswara Rao, and S. Ravindra Bhat in the suo moto matter of Covid 19 management underlined that the Constitution does not envisage courts to be silent spectators when the Constitutional rights of citizens are infringed by executive policies. The Supreme Court held that the Centre’s policy of arranging free vaccines for 45+, healthcare workers and frontline workers while the age group of 18-44 years has to pay for vaccination is prima facie arbitrary and irrational. The Court directed the Centre to undertake a fresh review of its vaccination policy to address the issue raised.

Actress and Environmentalist Juhi Chawla recently filed a petition against the rollout of 5G telecommunication services. Chawla in her petition pleaded that until and unless the 5G technology is certified safe, it should not be permitted to be rolled out. The Court observed that there were several shortcomings in Chawla’s plaint in terms of the Code of Civil Procedure. The Hon’ble Supreme Court remarked that the union budget for the financial year of 2021-22 had set aside a sum of Rs. 35,000 Crore for procuring vaccines. The Court asked the Union Government to clarify how Rs. 35,000 Crore, the vaccine budget, was spent. The Hon’ble Court further asked that why these funds cannot be used for giving free vaccination to the age group of 18-44 years.

While accepting an anticipatory bail plea filed by a police constable, Jugendra Singh in a corruption case, Hon’ble Justice Siddharth of the Allahabad High Court held that irrational and indiscriminate arrests are a gross violation of human rights. The Courts have repeatedly held that an arrest should be the last option for the police and it should only be done in exceptional cases.

'Solitary Incident Not Justifiable Ground For Transfer': Calcutta High Court Tells CBI In Narada Case
The hearing in the Narada Scam case continued on Wednesday, June 2. The CBI had filed a transfer application for the trial. CBI also argued that the hearing on May 17th which led to the bail granted to the four TMC leaders was vitiated on account of mobocracy. In the hearing on Wednesday, Hon’ble Justice Soumen Sen held that a solitary incident is not a justifiable ground for allowing the transfer of proceedings. It was his opinion that there should be a continuous set of events to make it clear that if the trial is continued, it will be vitiated.

The Division Bench judgment in Radha K. S. vs.Sadasivan and Anr. held that provisions under Order 1 Rule 8 of the Code of Civil Procedure have to be complied with at the Appellate stage. The Three-Judge Bench of Hon’ble Justices C. T. Ravikumar, V. Shircy, and K. Haripal declared that this judgment was not correctly decided and held that publication of notice under Order 1 Rule 8 of the Code of Civil Procedure is not mandatory at the appellate stage of a Representative suit.
