Chhattisgarh HC: Widow Loses Right In Property Inherited From Previous Husband On Valid Remarriage
The Chhattisgarh High Court has established that a successful and valid remarriage of a widow makes her lose all rights over the property inherited from her deceased previous husband. The decision was given by the Single Bench of Justice Sanjay K Agrawal. The case was of Loknath V. Shribachahh Kumar Bhoi and Ors. Section 2 of the Hindu Widow’s Remarriage Act, 1856 has provisions which state that the rights of widows in her deceased husband’s property ceases after a valid remarriage.

Two petitions had been filed in the Tamil Nadu High Court which challenged the Tamil Nadu Special Reservation of Seats in Educational Institutions and in appointments under the State within Reservation for Most Backwards Classes and Denotified Communities Act, 2021. The court had refused to stay the legislation. The matter was heard by a Bench consisting of Justice L Nageswara Rao and Justice S Ravindra Bhat.

Chhattisgarh HC: Interim Compensation Under S.143A of NI Act Is Directory
The Chhattisgarh High court has held that Section 143A of the Negotiable Instruments Act, 1881 for compensation is not discretionary, but directory. The decision was given by Justice Narendra Kumar Vyas. The decision of the Judicial Magistrate was upheld by the Court which granted 20% of the cheque amount as the compensation. The case was of Rajesh Soni V. Mukesh Verma.

Madras HC: Right To Religion Takes Back Seat When Right To Life Is Threatened; PIL To Reopen Temples Declined
It has been observed by the Madras High Court that the Right to Religion is subservient to the Right to Life. The plea that was filed sought the reopening of temples. The decision was given by Chief Justice Sanjib Banerjee and Justice Senthil Ramamoorthy. When the Right to Life is threatened, the Right to religion takes a back seat. Moreover, the Court also stated that matters like these were to be decided by the State and not the Court.

Supreme Court To Consider If CCS Rules Can Deny Maternity Leave To Woman With Step Children
The case was of Deepika Singh V. Central Administrative Tribunal. The Punjab and Haryana High Court had refused to grant maternity leave to the woman as she has two step children and the newborn was not her first child and upheld the Tribunal’s decision. A petition challenging the Central Civil Service Rules had been filed. The matter will be heard by Justice D Y Chandrachud and Justice M R Shah. However, no stay has been granted on the High Court’s order.
