Andhra Pradesh HC: Girlfriend/Concubine Not Liable For Prosecution Under S.498A IPC 

Section 498A of the Indian Penal Code criminalises cruelty to women. The Andhra Pradesh High Court has  held that only a relative of the husband by blood or marriage is liable for prosecution. The husband’s girlfriend or concubine cannot be made liable under this Section. The case was of Anumala Aruna Deepika v. State of Andhra Pradesh. The decision was given by Justice Cheekati Manavendranath Roy.

Centre Claims No Deaths Due To Lack Of Oxygen During Second Wave

The Centre has claimed in the Rajya Sabha, during the Monsoon Session of the Parliament, that there have been no deaths reported by the States and Union Territories due to the lack of oxygen during the second wave of the COVID 19 pandemic. The Union Health Ministry stated that ‘Health’ was a state subject and detailed guidelines had already been issued by the Centre. The claims of underreporting of COVID related deaths were dismissed by the Union Health Minister, Mansukh Mandivya.

SC: S.34 Of Arbitration Act Gives No Power To Modify Arbitral Award

The Supreme Court has held that a court cannot alter or modify an award under Section 34 of the Arbitration Act. The decision was given by Justice R F Nariman and Justice B R Gavai. The case involved was of Project Director, National Highways vs. M. Hakeem. The Court also stated that the Parliament too had noted that no power to modify reward exists under S.34 of the Act.

Raj Kundra Remanded To Police Custody In Pornographic Film Case

In the recently uncovered pornographic case, regarding the alleged production and distribution of explicit material, businessman Raj Kundra and his associate, Ryan Tharp have been remanded to police custody by the Chief Metropolitan Magistrate Court at Mumbai. The charges against the accused are under Sections 354(C) (Voyeurism), 292 (sale of obscene content), 420 (cheating) of the IPC and Sections 67, 67A (transmission of sexually explicit material ) of the IT Act along with Indecent Representation of Women (Prohibition) Act.

Bombay HC: Animal Sacrifice Permitted Only In Licenced Slaughter Houses

Two separate Benches of the Bombay High Court have instructed the different municipalities of Maharashtra to ensure that animal sacrifice takes place only in registered and licensed slaughterhouses. The decision was given by Chief Justice Dipankar Datta and the second order was passed by the Division Bench led by Justice S S Shinde. The cases involved were Gau Gyan Foundation V. State of Maharashtra and Jiv Maitri Trust V. State of Maharashtra & Ors.

SC: Interim Protection Under S.482 CrPC Can Be Passed In Exceptional Cases

The Supreme Court has observed that High Courts can pass interim protection orders in certain exceptional cases under Section 482 of the Indian Penal code, although this has to be done by giving brief reasons. The decision was given by Justice Indira Bannerjee and Justice V Subramanian. The case was of A P Mahesh Cooperative Urban Bank Shareholders Welfare Association Vs. Ramesh Kumar Bung. The appeal was dismissed by the Bench.
