BACKGROUND

  • The applicant expressed his grief and anguish through a post on the social media platform Facebook, over the death of his wife in a government hospital in Meerut.
  • Subsequently, he was booked under Sections 504, 507 IPC, Section 66,67-A of the IT Act, and Section 4 of the Uttar Pradesh Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage to Property) Act and his case is pending before Additional Chief Judicial Magistrate-I in Meerut.
  • The applicant filed an application before the Allahabad High Court under Section 482 CrPC, where he sought the quashing of the charge sheet, further orders of summoning, and the entire proceedings related to the case.

SUBMISSIONS

  • The counsel for the applicant submitted that the applicant had complained to the Chief Medical Officer, District Meerut regarding the matter relating to the death of his wife.
  • He also submitted that the entire proceedings are malicious and are carried out to cause harassment to the applicant.

ORDER

  • The court noted that the matter required consideration and therefore stayed further proceedings before the Meerut Court.
  • It issued notice to the opposite parties to file their affidavits and rejoinders within the given time.
