The Supreme Court permitted a Congress activist from UP, Vishwanath Chaturvedi, to file an application in the apex court seeking directions to the CBI to submit its preliminary inquiry report to the competent court and not to the Union Government in the disproportionate assets case against former UP Chief Minister Mulayam Singh Yadav and his family members. On March 1, 2007, the Supreme Court had directed the CBI to conduct a preliminary inquiry to ascertain whether prima facie a case of corruption against Mulayam Singh Yadav and his family members is made out, with the direction to submit its report to the Centre, which will decide the future course of action. SP supremo Mulayam Singh Yadav, his two sons Akhilesh Yadav (MP), Prateek Yadav and his daughter-in-law Dimple Yadav are facing allegations of acquiring assets worth over Rs 100 crore through corrupt means, by misusing the status of Mulayam Singh as Chief Minister. Chaturvedi, on whose petition the directions were issued by the Supreme Court, in his fresh application, has prayed to the apex court to modify its earlier order to the extent of dropping the directions to the CBI to submit its report to the Union Government. He has also prayed to the court to direct the CBI to register a regular case against Mr Yadav under the Prevention of Corruption Act. According to the applicant, the CBI has taken a U-turn under the orders of the Union Government which now wants to reward Mr Mulayam Singh for the support to Manmohan Singh Government during vote of confidence in Parliament following withdrawal of support by Left parties in protest against Indo-US Nuclear Deal. A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam granted the permission to the applicant to file his application when the matter was mentioned before the bench for permission to file the modification application.
