Madras HC Issued Directions to Submit Road Map to Purchase Disabled Friendly Buses
A batch of writ petitions were filed seeking for use of disabled-friendly buses for upholding the rights of the persons with disabilities. The Court had prevented the State government from purchasing new public transportation bus unless they are disabled friendly. The State government had informed that the disabled friendly buses are far more expensive than normal buses and considering the economic status of the state due to pandemic, it would not be viable to purchase only disabled friendly buses. The Court dismissed the concerns and stated that appropriate measures should have been taken a long time ago for ensuring disabled friendly buses. The Court issued directions to the State government to submit a road map for the purchase of disabled-friendly buses within 4 weeks’ time.

Allahabad HC: Economic Offenders May Use Huge Proceeds To Affect Probe
The CBI had been given directions to conduct preliminary enquiry in the execution and implementation of National Rural Health Mission and fund utilization at several state levels. After investigation several persons were charged under provisions of the Prevention of Corruption Act. One of the accused had filed for an anticipatory bail before the Court to which the Court stated that people involved in economic offences have larger amount of proceed of crimes and they may use their powers to affect the investigation and win over witnesses since they have attained the proceed by deceiving others.
Do you agree with the Court’s views of economic offenders having the power to influence the investigation?
Accused Moves to Kerala HC in Illegal Rosewood Trees Felling
The petitioners were accused of felling centuries old rosewood trees from reserved forest in Wayanad. The charges were for cutting and transporting of logs of rosewood without getting a valid permit for the same which the petitioners contended that no permission for cutting trees from own property was required. They claimed to be innocent and requested for bail stating that they had been arrested when they were en route to their mother’s funeral and there has been a delay of more than 7 months on the part of authorities in registering the offence when the alleged offence had occurred in December last year.

Bombay HC takes Suo Moto Cognizance of Effects of Immersion of Idols in Water
The Nagpur Bench of Bombay High Court has taken suo moto cognizance of examining the adverse impact of immersion of biodegradable Ganesh or other idols in water bodies. The Court imposed a ban on use of Plaster of Paris idols. The regulations on use of PoP by idol makers was challenged before the Court and the Court considered making regulations for use of oil paints and synthetic colours for decorating the idols. The makers were asked to give an undertaking to stop making idols from PoP and the already made idols should be sold with a disclaimer to the customers.

Magistrate has the Power to Permit Officer Below Inspector’s Rank to Assist in Investigation: Prevention of Corruption Act
The Special Judge had declined the application by CBI seeking permission for the sub-inspector to assist in the IO in conducting investigation aginst BHushan Power and Steel Limited and Ors. The order was challenged before the High Court. The Delhi High Court ordered that a special judge has the power to permit any officer below the rank of Inspector to assist the IO in investigation in cases under Prevention of Corruption Act under direct supervision of the IO only. But the responsibility and accountability would lie on the Investigating Officer.
