MP HC ORDERS GUJRAT GOVT TO DESTROY WASTE STORED TT UNION CARBIDE PLANT 12/17/2008 The Madhya Pradesh High Court ordered the Gujarat government to destroy 350 metric tonnes of poisonous chemical reside stored in containers on the premises of the Union Carbide plant that was closed after the 1984 Gas Tragedy. While hearing a public interest plea by Mr Alok Pratap Singh, Chief Justice Anang Kumar Patnaik and Justice Ajit Singh ordered the neighbouring state’s regime and the Gujarat Pollution Control Board to destroy the waste at an Ankleshwar-based plant that is specially equipped for the purpose. The order also directs a task force, which was formed in Madhya Pradesh vis-a-vis waste disposal, to soon begin the work of conveying the reside to Ankleshwar. The waste was earlier placed in containers as per a court order after the Gujarat government agreed to dispose it. However, the regime later backtracked owing to some pressure and the Ankleshwar plant being ‘bogged down’ with other work. Another court order followed and a central team inspected the Ankleshwar plant before submitting a report accompanied by an affidavit to the court. The report said, after November 15, the plant would be free to destroy the reside. February 3 was set as the next date for hearing when the Gujarat government would have to submit a report. The petitioners were represented by Advocate Naman Nagrath, the Dow Chemical Company -- that now owns Union Carbide -- by Adv Abhishek Manu Singhvi and the Centre by Adv Dharmendra Sharma.
