Uttar Pradesh government started its argument in the special appeal filed against the single Judge order in police recruitment scam case. Senior advocate of the Supreme Court, P P Rao argued on the special appeal for about half-an-hour and indicated about the mistakes committed in single Judge order. The Court has fixed January 6, 2009 to re-hear the appeal as fresh case. This order was passed by a division bench consisting of Justice Janardan Sahai and Justice Rakesh Sharma on a special appeal, filed by the UP government against the single Judge order, whereby dismissal order of more than 17,000 police constables were annulled on December 8, 2008. Arguing on the state’s appeal, senior advocate P P Rao assisted by Chief Standing Counsel, M C Chaturvedi had pointed out the Court in crux that the sole consideration for adjudicating of the case before the single judge was that as to whether there was any kind of irregularities committed during the selection of the constables and whether constables were illegally dismissed from service or not. The submission of the senior advocate of Supreme Court was that both the said points were not discussed by the single judge in the impugned judgement. The Court, however, adjourned the hearing of the state’s appeal till January 6, 2009 saying that the hearing of the appeals will continue after hearing the parties and the final judgment delivered.
