MADRAS HC RESTRAIN ON CIC ON OFFICER ON SPECAIL DUTY

Madras High Court restrained Chief Information Commissioner (CIC) Ramakrishnan and six other Commissioners from allowing Mr Dhandapani to function as Officer on Special Duty cum Registrar.

While admitting a writ petition, Mr Justice P Jyothimani directed the CIC to file counter within two weeks.

In his petition, Retired Professor S Mahalingam challenged the continuance of Mr Dhandapani whose services were not extended beyond July 2007 by the government.

When the Tamil Nadu Information Commission was constituted in 2006, the CIC was permitted by the government to make temporary appointments to the post of officer on Special Duty pending government orders, the petitioner contended.

Accordingly in February 2006, Mr Dhandapani was appointed as OSD-cum-Registrar as a stop-gap arrangement.

Subsequently, in January 2007, the government had appointed an IAS officer, Mr Ashok Ranjan Mohanty, as the Secretary-cum-Registrar of the TN Information Commission.

‘However, the CIC did not allot work to Mr Mohanty and instead Mr Dhandapani was allowed to discharge functions of a Registrar,’ the petitioner added.
