According to the Kerala High Court, having gold in your pocket without the necessary paperwork raises suspicions of tax avoidance.

There is no reasonable explanation, according to Justice Gopinath P. bench, for the mismatch between the number of documents the petitioner brought before the department that evening and the amount of gold that was taken from the petitioner.

The petitioner is the owner of a business called "One Gold," which is located in The neighborhood at Chembukkavu. From Thrissur to Alleppy, one of the petitioner's close friends was taking the train. On the petitioner's request, he was transporting some gold items from Thrissur to Alleppy.

The members of the Railway Protection Force seized the petitioner's acquaintance (RPF). He is said to have produced some documents on his phone when asked for the paperwork necessary to transport the gold, but the Railway Protection Force did not find these documents to be sufficient. According to reports, the petitioner's premierralmber of documents that she believed were adequate to prove that the gold was being moved lawfully with GST regulations.

However, the GST Department was given the case by the railway police.

Arguments of petitioner 

The petitioners argued that the products had all the essential documentation to show that they were being carried in full conformity with the GST legislation by the time the GST authorities intercepted them.

The petitioner claimed that the respondent started and ended proceedings under Section 130 of the CGST/SGST Acts by completely ignoring the materials that were made accessible to the petitioners.

The court found no evidence of malice, ill will, or lack of jurisdiction in starting legal byce with Section 130 of the CGST/SGST Acts.

Court conclusion

The court concluded that the petitioners would be free to present all of their arguments before the appellate authority while dismissing the writ petition. When an appeal is lodged, the appellate authority will evaluate the case without regard to any of the judge's observations.
