SC Rejects Alleged Rape Vvictim's Plea For Not Taking Blood Sample 1/17/2009 The Supreme Court turned down the plea of an alleged rape victim seeking directions to the police for not taking her blood sample in a case which involves senior officers of Delhi Jal Board and MCD. According to the complainant, she was sexually assaulted on the promise that work will be given to the firm in which she was employed. Later on officials allegedly prepared a CD and blackmailed her. Additional Solicitor General Gopal Subramaniam appearing for the state of Delhi, however, alleged before a bench comprising Justices B N Agarwal and G S Singhvi that the possibility of the prosecutrix blackmailing the officials cannot be ruled out and therefore, she must be directed to give her blood sample so that the allegations made by her may be verified. Mr Subramaniam also told the court that all the accused have given their blood samples. Incident had allegedly taken place in October 2006 and the complaint was lodged in June 2007. Senior Counsel Ranjit Kumar appearing for the petitioner, however, contended that under law she was not bound to give her blood sample and all the accused are influential people and can manipulate the facts, including the FSL report.
