SC Commutes Death Sentence For 3 Accused 1/23/2009 The Supreme Court has commuted to life imprisonment the death sentence awarded by the trial court to two brothers for killing their brother-in-law by cutting his body into pieces over his illicit relations with another lady. A bench comprising Justices Arijit Pasayat and Mukundakam Sharma in their judgement delivered while commuting the sentence of Parkash Sakha Vasave and his brother Ramu noted, ‘We therefore set aside the judgement of High Court so far as their acquittal (two brothers) is concerned. But considering the facts of the case, it is apparent that the accused person were annoyed with the deceased because of his illicit relationship with another lady while his wife was alive. The case des not fall in the rarest of rare category. The appropriate sentence would be life imprisonment.’ The state of Maharashtra had come in appeal against the acquittal of all three accused by the Bombay High Court. The brutal incident had taken place on July 16, 2001 when the deceased Madhukar who was married to the sister of the accused person Jaitubai was attacked with axes. Parkash cut the left hand and right foot of Madhukar. The blow given on the head of the deceased by accused number two was so severe that handle of the axe was broken and the axe got stuck up four-five inches into the head of the deceased. No family member who was present on the spot could muster courage to come to the rescue of the deceased. Third accused Shiva who was sentenced to life imprisonment by the trial court was however, acquitted by the Supreme Court. UNI
