The Supreme Court stayed till further orders the Bombay High Court order, directing the Mumbai Municipal Corporation (MMC) to kill all stray dogs in Mumbai. Coming to the rescue of unfortunate animals, a bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam also issued notices to the Maharashtra government and the MMC on the petition filed by All India Welfare Board, who contended that these dogs can be sterilised instead of being killed, which amounts to being cruel to hapless dogs. Senior counsel, appearing for the petitioner, also contended that the Bombay High Court had committed a mistake by vacating the interim stay taken by it against the killing of stray dogs in 1998. The High Court had vacated the stay in December last year and the Board had challenged this order in the apex court. The High Court had vacated the stay after it was informed that stray dogs in the commercial capital of India have become a menace and the MMC cannot kill them in view of the stay granted by the High Court earlier, directing the authorities not to kill stray dogs and sterilise them instead.
