Amidst debate over the recent amendment in the CrPC, Chief Justice of India K G Balakrishnan on Saturday said that the police has not been given blanket power to arrest a person and the change in the provision would help reduce harassment in dowry cases. "Police has not been given blanket power. After this provision police will have to give reasons for why the person is being arrested," he said at a seminar on "Marriage Laws-Issues and Challenges" organised by National Commission for Women (NCW) and the National Legal Services Authority. The CJI said the amendments in the Code of Criminal Procedure (CrPC) would help in reducing the harassment of people in dowry-related cases where section 498A of IPC has been misused. With regard to the proper implementation of the marriage law in the country, the CJI appealed to all lawyers to use the litigation in a rightful manner. For speedy disposal of matrimonial cases, the CJI said there should be atleast one family court in each of the 465 districts of the country and told lawyers not to object to this step. About the uniform civil code, Justice Balakrishnan said that in view of existence of various religions in the country there are about 15 marriage-related laws and a Uniform Civil Code is not possible but sought the NCW's suggestions for redressal of marriage-related disputes.
