Stolen Car Sold To Man, Court Awards Compensation 12 Feb 2009, 1808 hrs IST, PTI Text: NEW DELHI: A Mitsubishi Lancer car owner, who was sold a vehicle involved in a theft case, has been awarded a compensation of over 3.5 lakh by the Delhi Consumer Commission which pulled up a car dealer for not verifying that the police were hunting for it. "Sidharth Gaind should be awarded adequate compensation for having suffered some harassment or mental agony or physical discomfort or financial loss," the panel headed by President Justice J D Kapoor said. Kotak Mahindra Primus Ltd (KMPL), which sold the car to a firm in Karol Bagh from which Gaind bought the vehicle, approached the Commission challenging the district forum order to refund the entire cost of the car (Rs 5.5 lakh) to Gaind. Gaind, who purchased the car in 2002, was learnt that his vehicle was required in a theft case when the police seized it for a short period. He was told that the vehicle was also involved in a dispute between its previous owners. Partly accepting Kotak's plea, the commission noted that the vehicle has been used continuously for four years so he need not be given the entire cost of the car as compensation. "Since Gaind had enjoyed the fruits of the vehicle by using it continuously for more than four years, it was not justified on the part of the Forum to direct the KMPL to refund its entire cost," it said, adding the amount would be depreciated at the rate of 10% per year, thus, putting the compensation amount at Rs 3.5 lakh
