SC refuses to extend stay on transfer of cases from POTA court New Delhi | Friday, Mar 6 2009 IST The Supreme Court today declined to extend the stay granted by Gujarat High Court to enable the victims of Godhra train carnage to approach the apex court. The Gujarat High Court had stayed for 15 days its order directing the transfer of those cases from POTA to sessions court in which the POTA proceedings were dropped by the Supreme Court last year. The Supreme court has accepted the recommendations of the POTA review committee constituted by the Union government to review all the POTA cases in Gujarat and had directed that POTA cases against about 120 accused shall be dropped and they be tried by the sessions court. The apex court had also directed that aggrieved persons can however, challenge the recommendations of POTA review committee in Gujarat High Court. A bench comprising Chief Justice K G Balakrishnan and Justices Markendey Katju and P Sathasivam however, also issued notices to state of Gujarat on the petition filed by Maganji Sardarsinh Vaghela challenging Gujarat High Court order vide which his petition against dropping of POTA charges against some of the accused has been dismissed. It also issued notice on the application seeking stay on the impugned order of Gujarat High Court till the final disposal of the petition.
