3/26/2009 The Delhi High Court issued notices to the Delhi Lt Governor, Delhi Legislative Assembly Secretary besides Chief Secretary, Delhi Legislative Assembly Speaker and Industries Secretary in connection with the alleged wrongful repatriation of the services of Mr Chattar Sen, private secretary to the speaker of Vidhan Sabha to his parent organisation. Justice V K Shali, while issuing the notices last week, restrained the Delhi Assembly from filing the post of private secretary to the Speaker of the legislative Assembly till April 2, the next date of hearing. Mr Sen approached the Delhi High Court seeking quashing of the orders of the Delhi Assembly Secretary (administration) issued on January 30, 2009, repatriating him to his parent body though he was confirmed on the existing post of PS to the speaker on July 12, 2006. Justice Shailley, while staying the filling of the post till further orders said, I have carefully perused the records and Prima facie it is clear that Mr Sen resigned from his post of a Store keeper of parent department namely High Tech Vocational Training Centre-Deptt of Industries Govt of Delhi with effect from July 12, 2006 and was permanently absorbed in the Delhi Vidhan Sabha on a vacant post of the private secretary to the speaker with effect from July 13, 2006. The Court said, It is strange that after permanent absorption of Mr Sen he has been repatriated by the Secretary Administration Siddhart Rao by his order of January 30, to his erstwhile parent body namely the Delhi Administration. Mr Ajesh Luthra lawyer for Mr Sen said the repatriation order by Delhi Govt is illegal, arbitrary and violative in law as any person who has been absorbed on a permanent post cannot be repatriated to his parent body.
