A bench comprising Justices B N Agarwal and G S Singhvi dismissed the petition filed by the AIADMK, headed by former Chief Minister J Jayalalithaa seeking to prosecute Mr Karunanidhi and Mr Baalu, for deliberately defying the September 30, 2007, order of the apex court, directing the ruling DMK and its alliance not to enforce state-wide bandh on October 1, 2007. The apex court held that no case for initiating the contempt of court proceedings was made out and therefore the petition was being dismissed. Others who have been discharged are former Chief Secretary L K Tripathi, state Transport Minister K N Nehru, State Transport Secretary Sarangi and the then DGP of state. The AIADMK in its petition had alleged that the state government connived with the agitators causing tremendous hardship to people of the state.
