Google wins domain names from Indian firms at WIPO

Google Inc, the world's largest internet company, has clinched victories on disputes on domain names at the World Intellectual Property Right Organisation (WIPO) against two Indian entities. The WIPO Arbitration and Mediation Centre has transferred domain names "googlehrd.com" and "mygooglemoney.com" used by Kolkata-based Ascio Technologies Inc and Net Jobs of Rajasthan to the Google. Google, which has 60 per cent of the market share in worldwide searches, had complained to the WIPO, a UN agency to protect IPR, that Sudam Chakraborty and Thilak Raj, owners of the two Indian firms, robbed its trade name for commercial purposes. Christian Schalk, who was appointed as sole panelist in both the cases, held that both the domain names were registered in "bad faith" and the Indians running their commercial interests through them had no right over the trade name "Google", which was used to confuse internet users. The complaints were decided under Uniform Domain Name Dispute Resolution Policy (UDRP) last month after Chakraborty and Raj failed to fulfil the requirements of the notice sent to them by the Geneva-based arbitration tribunal.
