Chances of Pilibhit BJP candidate Varun Gandhi being released from jail brightened when the Supreme Court today sought an undertaking from him that he will not make any provocative and inflammatory speech if released from jail. A bench comprising Chief Justice K G Balakrishanan and Justice P Sathasivam fixed the matter for hearing on April 16 for further consideration of the petition of Mr Gandhi challenging the decision of UP Chief Minister Mayawati invoking national security Act (NSA) against him for his alleged hate speeches threatening minority community in Pilibhit. DM Pilibhit Ajay Chouhan had later invoked the NSA against Mr Gandhi following large-scale violence during his surrender before the court. On April 2, the Supreme Court issued notices to Mayawati government and Pilibhit DM on the petition filed by Mr Gandhi challenging the validity of the action of the State government invoking NSA against him. Initially he was arrested under Section 153 A IPC (disturbing communal peace and harmony) but later on NSA was slapped on him. He is presently lodged in Etah jail where he was shifted from Pilibhit jail. Senior counsel Mukul Rohatagi appearing for the petitioner agreed to the suggestion of the court that Mr Gandhi will have to give an undertaking that he will not make any inflammatory speech on being released on bail till the final disposal of his petition. Senior counsel Harish Salve appearing for the UPA government had earlier contended that Mr Gandhi was posing grave and serious threat to communal peace and harmony in the State and was a national threat and his release on bail might lead to serious problem of public order. Gandhi is to give an undertaking till Thursday when his petition will be taken up for further hearing.
