New Delhi: The Supreme Court on Wednesday dismissed an appeal filed by the former Director General of Police (DGP), Kerala, P. Vijayan, challenging his prosecution by the Central Bureau of Investigation (CBI) in the alleged fake encounter killing of Naxalite leader Varghese in 1970.
A Bench headed by Justice P. Sathasivam allowed the 85-year-old appellant to move the special CBI court in Kerala for exemption from personal appearance during trial. The CBI had earlier framed charges against the former DGP on the basis of statements made by retired police constable Ramachandran Nair.
He had confessed that the killing was at the behest of superior officers including Vijayan, a Deputy Inspector General then.
