IN THE HIGH COURT AT BOMBAY APPELLATE SIDE Press Advertisement No.A.5504/2008 Applications are invited for 14 vacancies for the posts of District Judges, in the Judicial Service of the State of Maharashtra in the revised pay scale of Rs.16750-400-19150-450-20500+dearness allowance and other allowances as admissible under the Rules. 1) A candidate must be (a) a citizen of India or (b) a subject of Nepal or (c)a subject of Bhutan or (d) a Tibetan refugee who came over to India before 1st January, 1962 with the intention of permanently settling in India or (e) a person of Indian origin, who has migrated from Pakistan, Burma, Sri Lanka (formerly Ceylon), or East African countries of Kenya, Uganda and the United republic of Tanzania (formerly Tanganika and Zanzibar) with the intention of permanently settling in India, provided that a candidate belonging to categories (b), (c ), (d) and (e) must be a person in whose favour a certificate of eligibility has been given by the Government of Maharashtra. Candidate if selected, will first be appointed initially on probation for a period of two years. 2) A candidate must be - (a) a holder of Degree in Law (b) practicing as an Advocate in the High Court or Courts subordinate thereto for not less than seven years on the date of publication of Advertisement. Note: For the purpose of this clause in computing the period during which a person has been an Advocate there shall be included .....2/- :: 2 :: any period during which he/she has held the post of a Public Prosecutor/ Government Pleader or Judicial Officer. OR Must be working or must have worked as Public Prosecutor or Government Advocate for not less than seven years in the post or posts. In computing the period of seven years the period during which the candidate has worked as an Advocate shall be included. (c ) Age: Must have attained the age of thirty-five years and must not have attained the age of Forty-eight years in the case of candidates belonging to communities recognised as backward by the Government for the purpose of recruitment and forty-five years in the case of others, as on the date of publication of Advertisement. (d) Knowledge of Marathi:- Must be certified by the Principal Judge of the District, where the candidate practices, or within whose jurisdiction he ordinarily resides, to have sufficient knowledge of Marathi to enable him to speak, read, write and translate with facility from Marathi into English and vice-versa. 3) A candidate must submit with his/her Application attested copies of certificates showing:- i) his/her age as on the date of Advertisement. ii) his/her standing as Practitioner in Court. iii) that he/she is of good moral character from two respectable persons. iv) that he/she is certified to have sufficient knowledge of Marathi to enable him/her to speak, read, write and translate into English and vice versa. v) The copy of the Mark Sheet of LL.B. Examination. vi) any other certificates as may be deemed fit. :: 3 :: vii) a candidate belonging to backward class must also produce the certificate to the effect that he/she belongs to a community recognised as backward for the purpose of recruitment to the service under the Government of Maharashtra. 4) Certificate under 3(ii) may be signed in the case of the High Court by the Registrar General, High Court, Bombay or by the Registrar/Prothonotary & Senior Master, High Court, Original Side, Bombay and the Registrars of the High Court Benches at Nagpur, Aurangabad and Registrar, Panaji-Goa, as the case may be or in case of other Courts than High Court in Bombay by the Principal Judicial Officer i.e. Principal Judge, City Civil and Sessions Court, Greater Bombay, the Chief Judge, Court of Small Causes, Bombay and the Chief Metropolitan Magistrate, Bombay as the case may be and in the case of Mofussil by the Principal District Judge or by the Principal Judge of the Court in which the Applicant has practiced and should state the period during which the candidate has actually practiced. The certificates mentioned in 3(iii) may be signed by the Registrar General, High Court, Bombay or the Registrar/Prothonotary & Senior Master, High Court, Original Side, Bombay, the Registrars of the High Court Benches at Nagpur, Aurangabad and Registrar at Panaji-Goa, the Principal Judge, City Civil Court and Sessions Court, Greater Bombay, the Chief Judge, Small Causes Court, Bombay and the Chief Metropolitan Magistrate, Bombay and the Principal District Judges in the State or by the Principal Judge of the Court in which the Applicant is practicing or by the Principal of a College recognised by a University. The certificates mentioned in 3(iv) may be signed by the Principal :: 4 :: Judge, City Civil & Sessions Court, Greater Bombay or the Chief Judge, Court of Small Causes, Bombay or the Chief Metropolitan magistrate, Bombay and elsewhere by the Principal District Judge concerned. 5) Disqualification for appointment in the service: No person shall be eligible for appointment to the service- (a) if he is not a citizen of India; (b) if he is compulsorily retired, removed or dismissed from judicial service or from service in Government or statutory or local authority or failed to complete probation period in judicial service on any post, or in Government or statutory or local authority; or ( c) if he has been convicted of an offence involving moral turpitude or he is or has been permanently debarred by the Union Public Service Commission or any State Public Service Commission from appearing for examinations or selections conducted by it; or (d) if he directly or indirectly influences the recruiting authority by any means for his candidature; or (e) if he is a man, has more than one wife living and if a woman has married a man already having other wife; or (f) if he has more than two children. 6) Eligible candidates will have to appear for Competitive Examination/ Written Examination which shall be of not less than two hours duration with 200 marks. The High Court shall hold viva-voce examination carrying 50 marks of candidates who secure not less than 50% of marks at such written examination. Provided that Scheduled Caste / Scheduled Tribe candidates who obtain 45% or more marks in the written :: 5 :: examination, shall be eligible for the viva-voce examination. No candidate who secures less than 40% marks in viva-voce shall be considered for appointment. The candidates will have to appear for written examination and for interview if called for, in the Office of the High Court at Bombay. No travelling allowance or any expenses shall be claimed by the candidates appearing for examination and interview. A candidate who is found indulging in unfair practices viz., copying or mis-conduct during the course of examination, using electronic gadgets, question papers' tampering, influencing any official concerned with the written examination or oral test, will be debarred from appearing for written or oral examination as the case may be for that time or any number of years or permanently. The decision of the High Court as to the eligibility or otherwise of a candidate for admission to the written and viva-voce examination shall be final. 7) The selected candidates will be placed by Government, previous to their appointment, before a Medical Board and will not be appointed unless the Board certifies them to be both mentally and physically fit for the service of Government. 8) At the time of appointment, the selected candidates will have to give an undertaking that for a period of two years from the date on which they cease to be in service, they will not practice in any Court over which they had presided or Courts subordinate thereto. 9) Application should be submitted only by Registered Post or Speed Post in the prescribed format with copies of testimonials referred to above and two passport size colour photographs, one duly affixed on application and one in separate envelope without pinning it to any paper so as to reach the Registrar General, High Court, Bombay ñ 400 032, on or before 30th August, 2008. The application should be accompanied by fees in the sum of Rs.1,000/- for General category and ::6:: Rs.500/- for Scheduled Caste / Scheduled Tribe candidate, in the form of demand draft in favour of Registrar, High Court, Appellate Side, Bombay, payable at par at Bombay. Fees shall not be refunded in any case. The envelope should be inscribed as ìAPPLICATION FOR THE POST OF DISTRICT JUDGE IN THE STATE OF MAHARASHTRA.î The candidates are required to download the format of the application from the website of the High Court, i.e. http://hcbom.mah.nic.in. or obtained from the Office of the Registrar (Legal), High Court, Bombay or Principal Judge, City Civil Court, Bombay or any of the District Courts in the State. Applications received after prescribed date will not be accepted on any ground. 10) High Court reserves its right of short listing at the time of scrutiny of applications by applying uniform and reasonable norms.
