Under Article 235 of the Constitution of India, the administrative / disciplinary control over the members of subordinate judiciary in the States vests with the concerned High Court and the respective State Government. Further, in exercise of powers conferred under proviso to Article 309 read with Articles 233 and 234 of the Constitution, the State Government frames Rules and Regulations in consultation with the respective High Court. Giving this information in written reply to a question in the Rajya Sabha, Shri Salman Khurshid, Minister of Law & Justice, said that in view of this, Central Government does not maintain record of such enquiries nor does it have a mechanism to monitor the action taken on them.
