The Supreme Court stayed the order given by the Delhi High Court that allowed Rajeev Saxena, approver in the AgustaWestland chopper case, to go abroad for medical treatment. The apex court was hearing a petition filed by the Enforcement Directorate (ED).
The bench comprising of Justice Sanjiv Khanna and Justice B R Gavai heard the contentions of ED. They submitted that Rajeev Saxena was not based in India and the medical facilities could be provided in India. The opposite council responded that Rajeev Saxena was suffering from Blood Cancer and several other ailments. Furthermore, his relatives would act as sureties, who were depositing Rs. 5 crores each for guaranteeing his return.
Considering the arguments, the apex court has directed the AIIMS to set up a medical board for examination of Rajeev Saxena. The bench further asked the Director of AIIMS to submit a report regarding his health condition and the availability of medical facilities for the treatment.
The Delhi High Court had granted bail to Rajeev Saxena on medical grounds. He is one of the accused who was named in the Charge Sheet filed by ED in AgustaWestland scam.
