A PIL has been filed in the Delhi High Court for implementation of Mental Healthcare Act, 2017. The Act superseded the existing Mental Health Act, 1987.

Advocate Amit Sahni stated that the Act came into effect on 29 May, 2018. However, he objected that the Government has failed to constitute the State Mental Health Authority and the Mental Health Review Board as mandated in the Act. He further submitted that Police has failed to follow the procedure under Section 100(7) of the Mental Healthcare Act, 2017 stating the obligation on Police to lodge FIR when a person with mental illness is found homeless. The PIL also highlighted the absence of any programme by State Legal Service Authority, Delhi pertaining to the provision of free legal services to mentally ill persons.

The PIL is seeking directions to the respective authorities for proper and effective implementation of Mental Healthcare Act, 2017.
