Delhi Police’s Economic Offences Wing has filed a case against Sapna Chaudhary, Haryanvi singer and dancer on grounds of cheating and breach of trust.
Pawan Chawala, Director of P&M Movies Pvt. Ltd, who is concerned with the business of celebrity management filed a complaint against Sapna and others asserting that she did not follow the terms of the contract that was signed between them.
It was stated in the FIR that the agreement was breached by the famous Haryanvi singer as she accepted business activities that were against the contract terms.
WHAT IS CHEATING?
Section 415 of the Indian Penal Code (IPC) defines cheating as whoever dishonestly or fraudulently deceives a person to induce that person to deliver a property to any person or to consent to retain any property. It is punishable under Section 420 of the IPC.
Mens rea (mental state or intention of a person to commit a crime) has to proved as it is an essential ingredient of cheating.
WHAT IS HAPPENING NOW?
A celebrity management company registered a complaint against the singer and dancer and several others that include her mother and brother from criminal breach of trust, criminal conspiracy, misappropriation of funds, and cheating.
According to the First Information Report (FIR), it was argued in the complaint that the singer broke an artist management agreement which clarified that she would not work with any other company or join any other company or have direct or indirect contact with any client of the complainant.
The copy of the FIR stated that the preliminary inquiry of the joint complaint proved that the alleged persons, in the conspiracy with each other have cheated complainants by not giving back the loan. Prima facie, an offense under IPC is made.
